Jury gets a break, we are arguing evidence and jury instructions all day. Judge is a saint.

Jury comes back, devastating cross. Weekend's work pays off in spades (I hope) judge let's me go, hit it. Like I said, physicality has to go for a bit. Spent, back in office until 7:15 and done.

Tuesday
In to argue motions, lose the little stuff but we'll win the big stuff. Work late, tomorrow the first of two big days. Then be special master Friday. Hope for workout Thursday and yoga Friday but looks really dicey.

Wednesday
Hammer drops, we do not do well. Very late in office prepping for what now appear to be critical crosses next week. Time to bring it.

Thursday
Second day of defense. Unnecessarily long cross by defense has oxygen sucked out of courtroom by 10:00. Sarcastic and arrogant meet egotistical and bumbling. Not good. We get the last word and it better be good and clean.

Back to office, Late and feel weak. Do it, it will not get better unless you do.

Hiatus

Last week was light and this week turning out to be nonexistent.

Trial is a sprint and a marathon at once. The need to spend an hour in the office in the morning from 7:30 - 8:30 and return for two hours in evening is all consuming.

It is time to let it go. Something's gotta give and right here, right now, it's the lousy 6-8 hours per week I spend on physicality. I miss the endorphin rush, the hormone flood. For now not the guy who gets to spend his hours and days moving toward heavier and heavier weights. Rather, it's cortisol flood, the stressed client, the demanding judge and fucking 800.00 (each) an hour opposition for a bit here and something has gotta give. This'll be done soon enough and I'll get back to it.

Levon's Last Waltz

Rock of Ages is one of the best live albums. Ever. Recorded in 1971 with Joe Farrell, Snooky Young, Howard Johnson, Earle McIntire, and J.D. Parron on horns with arrangements by Allen Toussaint, the performance is a blown out romp. People say it's a toss-up between Rock and The Last Waltz, but I don't think it's even close. From the opening bass line on Don't Do It, The Band is tight as Levon's rimshot. Even with that monster horn section punching out Toussaint's licks, Robertson's searing guitar, and Danko's pounding bottom end, the center of it is Levon's soaring voice. That guy could sing. Don't Do It was a cover - no one has ever sung it better and for me it was an anthem to adolescent angst. A voice to real (in a prospective sense anyway) and imaginary romance. Levon's version howled straight from my heart. Later it was Life Is a Carnival from the same record, but Don't Do It has always pounded just below the surface.

As a world we'll be paying tribute for a while here. The next three weeks are going to be consumed with trial, but I'm gonna get out every night. Gonna work out on the road; shed the suit, sweat some place with a view and listen to the pure joy that is Levon's music. Long weekend.
Witness prep Saturday and then accounting document review, listening to Levon in 2008. Long week ahead. One of more than a few coming up.

Put it down at 7:30 and go out for some small movement:

In early for round 2 of bu fool around.
Stick cleans, very very close on double 24s, two single 28 bup right. Hit the groove and it's easy. Miss it and it does not happen. But don't make it a snatch. I've seen those videos and some folks are cheating a bit.

Head to dank basement gym for lunch with the office 24. Quick circuit:

Yoga. Fast and hard. Very strong on one leg series, screwing foot into floor and rock solid. Get out of your head-there is nothing but weight into floor and breath.

Thursday
Rest day planned.

Friday
In for bu practice. Barely one rep with the 28. Disgusted, grab twin 32's and clean & press; press the doubles. Hit it three times each one easier then the last. That's a PR. Time to start working seriously with the 36.
Late yoga. It's strong.
Belated bday dinner with CT, patient person and delightful company.

Brigid to Parkour, Rose to bay. Ecstatic in the rain. Taking people places, buying food, feeding them, being there while driving and picking them up all day. No training, no real rest, except 30 minutes listening to Joe Pass. Note to self: listen to more Joe Pass.

Been looking forward to yoga with B all week. 90 minutes, all in. Leave him there in warrior two, we'll catch him on the other side. Clean up office and up to Hayes Valley where B prompts massive quantities of smiles from young women and gay men. Why is it straight young men look baffled so often ?

Hit CT 4:30. Nothing heavier than a 20 kg but sweating straight through by the end and leave with plenty to work on. Cossack squats. Yes, there is a task.

At dawn don suit so can do special master duty later. Hello hip flexors from yesterday.
In for bu fuckaround. Sticking everything closer and closer on the twin 24 and three good bu press on the 28. Expect yoga late pm but gets waylaid by "I'm going to do my thing" which means sleep on the sofa bs.
Breathe.
Predictable consequence of overwhelming force is arrival of Very Large Law firm. Now facing six sharp suits across the table rather than tweedle dum et al.

Thursday
In early then most of the day in court. Oppositions ranks have grown, smoother now. Spend two and a half hours arguing "scheduling.". Race back for another handoff conference call. Hope I still have a practice when this is over. Decision not to file absolute correct one and co-counsel is grateful for restraint. We do make each other better, always have.

4:45 yoga. Head racing at start but gets better and better and at the end close to quiet.

Friday
Busy.
Leave for 4:30 Pradeep. Start off in savahnsana, means it's gonna be a sweatfest 15 minutes in. Plank work and long standing series at end. No lizard or pidgeon, just hit it.

Saturday
In for stair climb. Up BofA building in about 14 min with Brigid, Micah and CT. Big Fun and great meal at Green Chile Kitchen after. Yum. Then ice cream. Big yum. Drive around a whole bunch. At 6:45:

Just reviewing my texts, nearly every communication I have with the under 20 set starts with "Hey Dad could you . . ." with the following request for money, transportation, pick-ups, food-items, software, music downloads, Amazon purchase and the like. I could; S'ok.  But it gets more complicated.  It's B's 21st and Brigid is pissed because she wants him to have balloons, big dinner etc.  I got presents together, but the rest would have required someone other than me to organize due to day job, etc.  She is peeved and takes him upstairs to her sanctuary to watch a movie with her.  I am not invited.  So Dad, could you now leave us alone.  Yeah, I can do that too.  Sigh.

Good yoga, young moms in the row in front of me rocking it out joyful, snaking up from child's pose to cobra and back to dd, its early in the class before the sweat starts flying but it'll be good later too. I'm the oldest person in the room by a good bit but the equal of any in strength.

Digging out; only three clients pissed off at the end of the day.
Need to get bills out and receipts up. Trial killing me.

The return of JL saves my bacon. Free to plot implementation of policy of overwhelming force tomorrow morning, and keep the rest at bay.

11:30, 59 page order comes spilling through; doctrine of overwhelming force really could not have gone better. The shoe had not dropped, just the threat to wring out the last hope of settlement. He reverses field where he should have (in our favor) and slams the door (on them) citing liberally from my briefs and adopts my term "dilatory." I only say things like that when it's true; this is a smart judge and the lack of prior hyperbole pays off.   He listened, read, understood and that's all the tax payers of California can ask for. Apologies for consuming funds and time with this.
Late yoga. Perfectomento, out to psycho performance. Don't bite.

More cold and wet. Running work stuff starting at 8. Leave at noon after filing one motion and by 1:45 I can feel I'm going to have to dig deep to get anything in today in terms of sweat. Does not happen. Clean up calls and brief crises until 7:15.

Friday
Going to be conference calls until 11:30 then settlement conference. Get in at 7:30, grab the office 24 and head to the dank gym basement:

Driving around with Brigid driving for four hours. Wiring her brain, no workout. Surprisingly exhausting, watching her get better and feeling her relax. Another milestone till the big one when she leaves.

Up early to take I to Ross for a twelve hour tech run through. Head into the city to clean up office and hit gym - want to hit hard. My usual yoga classmates are lining up at the door while I'm lining up different colors of kettlebells, they look like dinosaur easter eggs, my own spring party, purple, black and orange.

Article 9 Acoustic

Yes, Firefly.  Get over it.

The Uniform Commercial Code was drafted (or as some would say "promulgated") by a group of philosopher kings full of good intentions.  Designed to standardize commercial transactions and promote interstate commerce, it was adopted more or less uniformly and now governs a great deal of what is flown, trucked, freight trained and barged around the country.  Article 2, which applies to all sales of goods over $500.00 between merchants is engrained into domestic commerce (yes, it still exists.)
Article 3 deals with commercial paper; Article 4, banks.  I have no fucking clue after 22 years practicing law what Articles 5 - 8 do.  Never hear about them, though I am confident there are a number of lawyers who specialize in nothing but who would be wryly amused at the dense non-specialist.

Article 9 deals with security interests in personal property.  Because security interests are always held by the strong over the weak, the philosopher king drafters left a fair amount of to be developed by the courts.  They recognized, to their credit, that too much specificity encourages mischief; it encourages form over substance.  In the Comments sections the drafters write words to explain what the words mean.  The Comments are not binding, but they are instructive and if you can find a good comment quote, it helps - often quite a lot.  Been getting quite a bit of mileage out of the comments to certain Article 9 provisions lately.

On the second day of three spent arguing motions in limine, we came to a doozy, Defendants sought to "prohibit the Plaintiff from discussing Article 9 in front of the jury."  This in nonsensical on a number of levels.  First, motions in limine go to evidence: facts, stuff people said, heard, smelled, tasted, etc.  No one witnessed Article 9 in this case, it is simply the applicable law as the judge has been reminding defense counsel, often.  Which leads the the second nonsensical level, even if it were evidence we will have enough difficulty keeping the jury awake in this case without waxing poetic about Article 9.  So we won't be spending a lot of time on it, except for in jury instructions.  There is no prejudice, you cannot be that stupid.

After spending three days dealing with Article 9 searching for some different dialogue.  Leo Kottke's brain was a good start.  Leo is an odd brilliant guy and it was with only a little displeasure that I had to blow off yoga to drive him briefly before listening to 90 minutes of acoustic mastery at Yoshi's.  That blew the philosopher kings out of the head for a brief bit before they would again become all consuming the following week.  Leo was a warmup to Warren Hellman's memorial, which B and I did not go to due to unfounded weather concerns, but did listen to, and have since, thanks to the stream which is still up at http://www.warrenhellman.org/warren/stream.shtml.  Enjoy.  The Weight at the end is especially joyful.  Boz doing Corinna, Corinna to open at 3:58:30 is wonderful; heard Leo do it last year.

Rolling depo questions non-specifically through head which is generally pretty good place to be a few days prior. Reports on social media point to a cold windy day for Warren's tribute tomorrow. Ugh, Barry does look good for that.
By 4:00 everyone is gone, clean up kitchen. Plan for dinner w/5. Crash on bed with dog.

Friday.
Depos, convinced that will be three days off in a row which have not done for years.  Feel ok about it, you're old and cortisol kills.  Start expert depo of CFO of defendant.  Made no sense for him to be designated and we agree after twenty minutes.  Spend an equal amount of time off the record discussing Leo Kottke and Warren's memorial and our dogs.  We like each other, drinks when this is over.
Get out early enough for ecstatic lab to get in a good marsh walk.  No, this will not be a three day rest.  Invigorated after walk, VO2 Max:

Saturday
Ballet day.  Take kids into sf early.  Ian wandering about, convince him he should check out Rhona Bennett who is sweet and beautiful and her band is a cast of characters.  Drop Brigid off for Bday party, more work.  Gym late late late, quick circuit:

Monday
All the fun advertised and more. Court, file oppos and grind out four hours of expert depo where they'd spent 140k since December 13 telling us our damage theories have them concerned.
Break out for 5:30 EH. She has been taking Pradeep's classes lately which translates to more plank work for us. Drenched.

Tuesday
9:00 calls. Up at 6:30 to drop I at bus and catch 7:10 boat.
Recovery day for suspended client relationships. Calls stacked up at 9, 10, 11, 1, 3 and 4.

Do not want to skip. Tired when get home at 7:15. Do not sit down, sitting down would mean not getting up again. straight upstairs for:
15/15 16kg snatches 7 rep pace x 70.
It's really a cardio workout but it feels good to move fast for 35 minutes under the adoring if quizzical gaze of the newly svelte labrador.

Wednesday
Up late, driving to boat resigned to 7:50. Pull into lot at 7:09, one minute to 7:10. If I make it I get 45 minutes of bu fuckaround on the other end so go. 200 yard sprint, no problem.
Work on double 24s for 20 minutes before client call takes my sweaty ass outside for 30.
But in that 20 the doubles are sticking. Eyes matter (a lot) and find good combo of hip velocity, grip and eye position to get five solid sticking cleans and 15-30 sec holds. Curious to see if it carries over to next time, which will hopefully be Friday.
Working late and bail at lunch for Pradeep. Good hard push, three side plank series and lengthy one legged plank series. Long long side series as well. Feel more than the over-used awesome. Trainer S tells me it's looking very very good; appreciate it and her youthful enthusiasm.
Good convo on the way over with former collegiate gymnast lawyer buddy from building who is as committed a yogi as I. Conclusion is that these thrice weekly yoga sojurns are essential for brain chemistry and assist law practice in ways that can be quantified (see receipts reports) and others not at all. Reinforced by call on the way back from out of state expert, concluding that yes, he will have to fly from Paris directly to sf at night and be prepared to testify in Alameda superior the next day. That he rang off thanking me and telling me he thinks I am one of the most interesting and positive lawyers he has met in a very long time I attribute almost solely to what I do away from the office. Completely fuck up his schedule and he's thanking me. No problem bud.

Thursday
Time for a total off day. Late conference call seals the deal; home to cook a good curry for all.

Friday
Need speed cause no time. Grab office 20kg for four
minute true tabata squat to press and run up 21 stories. Ok.
Pm, bail at 4:15 for 4:30 Pradeep. Good 60 min and stay for 40 minutes of next before heading up to collect Brigid at Parkour, she practicing Kong vaults for an hour.

Saturday
All day drive around
Three mile marsh walk with svelte lab and second son.

Sunday
In for 90 min yoga with Barry. He rocks it as usual. Three hours in the office and its up to CT where its mobility voodoo and 28kg swings, renegade rows, and presses.  It's a full class and feel like a troll. Bigger, louder and heavier than anyone else.  I sweat like a beast and spit when breathing heavy. I am not sure I should often be out in public.

Monday
Nutty day. Leave for 5:30 EH before prepping for tomorrow. Good class, but need to push heavy overhead.  By the time tomorrow is over I'm going to want to punch something too.
